Garden Suites in Hamilton: The $40,000 Grant and the Rules Behind It
Hamilton calls a backyard unit an Additional Dwelling Unit – Detached. The City will pay 70% of eligible costs up to $40,000 per unit. The catch: occupancy by August 4, 2027, and the grant comes due if you sell while money is outstanding.
At a glance
Urban GFA and height are in By-law 05-200 s. 4.33.2 (added by By-law 22-132). Your zone may sit under a former community by-law. Confirm with Hamilton zoning staff.
Yes, most urban Hamilton lots with a house can add a detached ADU. City materials show a 75 m² maximum floor area and 6.0 m height, and since March 2025 the separation from the house is 4.0 m with 45% lot coverage. Build with a permit issued on or after October 9, 2025, and you may qualify for a grant of up to $40,000 per unit.
We Don’t Build in Hamilton. We do read the fine print.
We are a builder in Tiny Township and we build in Simcoe County and around Georgian Bay through ICFhome.ca. Outside Simcoe, we sell lot reports, permit packages and builder calls. Hamilton is outside Simcoe.
So treat this page as a builder reading the rules for you, not a sales pitch for a crew. And in Hamilton the most valuable reading is the grant agreement, because $40,000 has conditions.
What Hamilton calls it
The City’s term is Additional Dwelling Unit (ADU). A unit inside the house is an ADU; a separate building is an ADU – Detached. You will also see “garden suite” and “laneway house” in City and grant material. In Hamilton’s rural area, “garden suite” often means the older temporary-use approval with an expiry date. If you are rural, read temporary garden suites too.
One local wrinkle: Hamilton is an amalgamated city. Most of the urban area is under Zoning By-law 05-200, but some properties are still governed by a former community zoning by-law (Stoney Creek, Glanbrook, Ancaster, Dundas, Flamborough and so on). The numbers can differ. Ask zoning staff which by-law your property is under before anything else.
Hamilton Detached ADU rules, urban and rural
Ontario Regulation 462/24 came into force in November 2024. Hamilton’s memo confirms it overrides angular planes and FSI, allows 45% lot coverage, removes urban minimum lot sizes, and caps separation at 4.0 m. By-law 25-033 (passed March 5, 2025) wrote the 4.0 m and 45% into Zoning By-law 05-200.
| Rule | Urban (By-law 05-200) | Rural (By-law 24-039) |
|---|---|---|
| Units | As reported in 2024, a single detached house may have two internal ADUs plus one detached ADU (up to four units). Confirm for your zone | Max one ADU – Detached, only on a lot with a single detached dwelling and at least 1.5 ha |
| Max floor area | Lesser of 75 m² or the house’s GFA (By-law 22-132) | Not more than the principal dwelling |
| Max height | 6.0 m (By-law 22-132) | 6.0 m |
| Separation from house | 4.0 m from the rear wall of the principal dwelling (reduced from 7.5 m by By-law 25-033) | 7.5 m from rear wall in the rear yard; 4.0 m from side wall and 5.0 m behind the front facade in a side yard |
| Side and rear setbacks | 1.2 m from interior side and rear lot lines (eaves may project 0.45 m) – By-law 05-200 s. 4.33.2, added by By-law 22-132 | 1.2 m from interior side and rear lot lines (eaves may project 0.45 m) |
| Lot coverage | 45% for all buildings on a lot with an ADU – Detached | 25% for all accessory buildings, farm labour residences and the ADU combined |

| Balconies | Check zoning by-law | No balconies or rooftop patios above the first floor |

Why we flag the 75 m² and 6 m. Both numbers are in the by-law text: By-law 22-132 (passed June 8, 2022) put the lesser of 75 m² or the house’s GFA, and 6.0 m, into s. 4.33.2 of By-law 05-200. The City zoning sheet repeats them. The March 2025 amendment changed separation and coverage but did not restate floor area or height. We have no sign they changed, but they are the two numbers your design hangs on, so confirm them with zoning staff or a Zoning Verification before drawings.
$40,000 per Unit, read the agreement first
Hamilton’s Additional Dwelling Unit and Multi-Plex Housing Incentive Program is funded through CMHC’s Housing Accelerator Fund. The program terms were revised in February 2026.
- Amount: 70% of eligible costs, up to $40,000 per eligible unit, with a $240,000 maximum per site. It is a grant, repayable only on default.
- Who: the registered owner, on a site inside the Housing for Hamilton Community Improvement Project Area (Sub Area 2, Roxborough, is excluded). Taxes current, zoning compliant, no outstanding property standards, Building Code or Fire Code orders, and not in litigation with the City.
- Timing: the building permit must be issued on or after October 9, 2025.
- Paid in two advances: first 20% of the estimated grant (based on a contractor’s estimate), up to $8,000 per unit. Then the balance, up to 70% of actual eligible costs, after the occupancy permit.
- Hard deadlines: occupancy permit within 18 months of conditional approval or by August 4, 2027, whichever comes first. Advance requests by August 4, 2027, or the agreement is deemed terminated.
- Eligible: costs required under the building permit and incurred after permit issue: materials, labour, new or upgraded HVAC and plumbing.
- Not eligible: appliances, decorative items, financing, consulting fees, and building permit plan preparation fees.
- Default: selling or transferring title while grant funds are outstanding, or failing to fix a non-compliance within 30 days of notice. The advanced amount is then repayable with interest at the City’s tax arrears rate.
- Stacking: the City says receiving this grant does not disqualify you from other municipal programs. Approval is discretionary and depends on funds.
What a builder notices here: the design and permit drawings are on your dime, the second advance waits for occupancy, and August 2027 is closer than it looks once you add a Committee of Adjustment hearing and a winter. Source: City of Hamilton program terms (Feb 2026).
How to Build a Hamilton ADU and keep the grant
Confirm the zoning by-law and the CIP area
Is your lot under 05-200 or a former community by-law? Is it inside the Housing for Hamilton CIP area and outside Roxborough? Both answers come before anything else.
Check the backyard
4.0 m from the back of the house, 45% coverage, landscaped area, and a clear route for materials and for firefighters. Note any conservation authority regulated area on the escarpment or near a creek.
Drawings and a contractor estimate
You need permit drawings and, for the grant, a complete construction cost estimate. Plan preparation fees are not grant-eligible.
Apply for the grant
Submit a complete application to the Housing Secretariat (Healthy and Safe Communities). The City makes no decision until your building permit is issued.
Get the building permit
Permit fees are set by the City’s fee by-law. Check with your town for the current rate. A minor variance, if needed, comes first.
Sign the grant agreement, request the first advance
Due diligence, Council or delegate approval, signed agreement, then a written request for up to 20% (max $8,000 per unit).
Build, occupy, claim the balance
Occupancy permit, ESA Certificate of Acceptance and approved invoices go in with the second advance request. All before August 4, 2027.
Development Charges and pre-approved plans
Development charges
Ontario’s Development Charges Act exempts an additional unit in an ancillary building on a lot where the main building has no more than two units. Most single-house garden suites in Hamilton fall under that. Education DCs and other fees should be confirmed with the City at permit time. More in our development charges guide.
Pre-approved plans
We did not find a Hamilton pre-approved detached ADU plan program as of October 2026. The pre-approved plans round-up lists the CMHC Housing Design Catalogue and cities that do offer plans.

Hamilton Ground has opinions
Old laterals in the lower city
Many lower-city houses sit on old clay or cast iron sewer laterals. Camera the line before you count on tying a new kitchen and bathroom into it.
The escarpment and creeks
Lots near the escarpment or a watercourse can be inside a conservation authority regulated area, which means a separate permit and slower timelines. Find out before the grant clock starts.
Rock and fill
Shallow bedrock in some areas and old fill in others can both change foundation cost. A frost wall in rock is not a weekend job. See foundation options.
Rural lots on private services
Rural detached ADUs need a 1.5 ha lot and on-site water and sewage capacity. If the septic needs to grow, septic design is done through SepticReplacement.ca.
Hydro upgrades
A heat pump, range and water heater in a new unit often push a 100 amp house over. Service upgrades are grant-eligible only if the permit requires them, so ask.
Heating design
Permit drawings need a heat loss and sized system. OntarioHeatLoss.ca prepares BCIN-stamped heat loss and HVAC design for permits.
What a Hamilton Garden Suite Costs, before and after the grant
We did not find a published Hamilton-specific cost study. The figures below are our builder estimate for a one-storey detached ADU of about 55 to 75 m² (600 to 800 sq ft) on an urban lot, finished for rent. Not a quote.
| Line item | Builder estimate | Grant-eligible? |
|---|---|---|
| Survey, drawings, permits | $10,000 – $30,000 | Plan preparation and consulting: no |
| Servicing to the house | $15,000 – $50,000 | Yes, if required under the permit |
| Foundation | $20,000 – $55,000 | Yes |
| Building and finishes | $140,000 – $240,000 | Mostly yes; appliances and decorative items no |
| Typical total | $200,000 – $350,000 | Plus HST |
| Grant if approved | Up to $40,000 | 70% of eligible costs, capped |

On a $280,000 suite, the grant is worth about 14% of the job. Real money, but not enough to rescue a lot that does not work. Run your numbers in the cost calculator and the ROI page.
How Hamilton Owners lose the grant or the budget
- Pulling the permit before October 9, 2025. Earlier permits do not qualify.
- Starting work before the permit. Only costs incurred after permit issue count.
- Missing August 4, 2027. Occupancy and advance requests both have to land before it. Plan backwards from that date.
- Selling mid-project. Transfer of title while funds are outstanding is a default, with interest.
- Assuming 05-200 applies. A former community by-law can change size and setbacks.
- Pricing appliances into the grant. They are excluded. So are financing and design fees.
- Treating a rural lot like a city lot. 1.5 ha minimum, 25% coverage, and the septic has to carry it.

Hamilton Garden Suite questions
How big can a detached ADU be in Hamilton?
Zoning By-law 05-200 (s. 4.33.2, added by By-law 22-132) caps an urban detached ADU at the lesser of 75 m² or the house’s gross floor area, with a maximum height of 6.0 m. On rural lots under By-law 24-039, the unit cannot exceed the floor area of the main house and is capped at 6.0 m. Confirm the urban numbers for your zone with City zoning staff.
How far does a garden suite have to be from the house in Hamilton?
4.0 m from the rear wall of the main house in the urban area. By-law 25-033, passed March 5, 2025, cut it from 7.5 m to match Ontario Regulation 462/24. On rural lots under By-law 24-039 the rear-yard figure is 7.5 m.
How much is Hamilton’s ADU grant?
70% of eligible costs up to $40,000 per eligible unit, and up to $240,000 per site, under the Additional Dwelling Unit and Multi-Plex Housing Incentive Program. It is paid in two advances, the first capped at $8,000 per unit. Approval is discretionary and depends on available funds.
What is the deadline for the Hamilton ADU grant?
The building permit must be issued on or after October 9, 2025. The occupancy permit must be issued within 18 months of conditional approval or by August 4, 2027, whichever is first, and advance requests must be in by August 4, 2027. The program terms do not list an application deadline, but funds are limited.
Do I have to pay the Hamilton grant back?
Only on default. Selling or transferring title while grant funds are outstanding is a default, as is not fixing a non-compliance within 30 days of notice. In that case the amount advanced is repayable with interest at the City’s tax arrears rate.
What lot coverage is allowed with a garden suite in Hamilton?
Up to 45% for all buildings and structures on a lot with a detached ADU, under By-law 25-033. Rural lots are different: 25% combined for accessory buildings, farm labour residences and the ADU.
Can I build a garden suite on a rural Hamilton property?
Yes, one detached ADU on a lot of at least 1.5 ha with a single detached house, under By-law 24-039, with 1.2 m side and rear setbacks and no balconies above the first floor. Some areas mapped in the by-law are excluded. You need on-site water and sewage capacity for the extra unit.
Does Hamilton have pre-approved garden suite plans?
We did not find a Hamilton pre-approved detached ADU plan program as of October 2026. Custom drawings or a design adapted from the CMHC Housing Design Catalogue are the usual routes.
Do you build garden suites in Hamilton?
No. We build in Simcoe County and Georgian Bay. For Hamilton we sell the $399 + HST feasibility report, permit packages, and builder calls, including a quote review that is handy before you submit a contractor estimate for the grant.
