Garden Suite Rules by City 71 Ontario municipalities, one table

The province sets the floor. Your town sets the numbers. We pulled size, height, terminology and grants for 71 municipalities from their own pages and by-laws. The spread is wide: from 35 m² in Brampton’s residential zones to no published cap at all in North Bay.

Provincial rules apply to urban residential land with full municipal services. Rural and septic lots follow the township by-law.

The short answer

On an urban Ontario lot with town water and sewer, the province lets you have up to three units, one of them in the backyard. It guarantees at least 45% lot coverage and caps separation rules at 4 m, but sets no size limit. Each town sets its own size, height and setbacks, from 35 m² in Brampton to no cap in North Bay.

How this page works

One Province, Seventy-One Rulebooks

Ontario did the big move in 2022 with Bill 23: additional units are allowed as of right on most urban lots. Then every municipality wrote its own numbers, in its own words, in its own zoning by-law. That is why your neighbour’s cousin in Mississauga is no help to you in Tiny Township.

Below you get the provincial baseline first, then a translation table for the words towns use, then every municipality we have checked, grouped by region with a link to our local page. If you just want your own town, the Rules Checker is faster.

We are builders. We have built more than 300 custom homes since 1979, and we read by-laws the way an inspector does: looking for the line that stops the job. Where a town does not publish a number, the table says so. We do not fill gaps with guesses.

Province-wide baseline

What Ontario Guarantees Before Your Town Says a Word

These apply to a parcel of urban residential land with full municipal water and sewer. Rural lots and lots on septic are not covered by the guarantees below.

Three units as of right

Under the Planning Act as changed by Bill 23 (2022), a serviced urban lot with a detached, semi or townhouse can have up to three units: three in the main building, or two in the main building and one in an ancillary building such as a garden suite.

45% lot coverage, at least

O. Reg. 299/19, as amended in November 2024 (O. Reg. 462/24), says a town must allow at least 45% lot coverage for all buildings on a lot with additional units. Setbacks can still control where things go.

No FSI cap, no angular planes

Floor space index limits and angular plane rules in a zoning by-law do not apply to lots with additional units under the amended regulation. That removed two of the quiet killers of backyard suites in older cities.

4 m separation cap

A town cannot require more than 4 m between a building with an additional unit and another residential building on the lot. Rules like Toronto’s 7.5 m separation for taller suites are exactly what this caps, so ask your city how it is applying the change.

No special minimum lot size

Minimum lot size rules aimed only at lots with additional units are overridden. A lot that is big enough for a house is big enough for the additional units, as far as minimum lot area goes.

Parking and DCs

Towns cannot demand more than one parking space per additional unit, and the Development Charges Act exempts the second and third units on a lot with a house. Confirm education charges and local wording with your town.

What the province does not set: maximum size, maximum height, side and rear setbacks, where on the lot the suite can go, and whether a rural lot on septic qualifies. Those are all local. That is why the table below exists.

Rural lots

On Septic? Different Game.

The three-unit guarantee and the December 2024 relief apply to urban land with full municipal services. On a rural lot with a well and septic, the township’s by-law is the whole story, and the septic bed is usually the first thing that says no.

Many townships now allow a permanent detached ARU on rural lots, often with a distance limit from the house (30 m in Tiny and Ramara’s hamlet zones, 50 m in Clearview, 75 m in Severn’s rural zones). Others still only allow a temporary garden suite: a temporary use by-law under the Planning Act for up to 20 years, with extensions, and an agreement to remove the unit later. That is a rezoning application, with fees and a public meeting, not just a building permit.

Rule of thumb from the field: get the septic checked before anything else. A designer can tell you in one visit whether the existing system can take the extra flow. Septic designs go through SepticReplacement.ca. The full rural process is on our temporary garden suite and rural and septic pages.

Where people go wrong

Reading a Rules Table Without Getting Burned

Read “the lesser of” twice

“Lesser of 50% of the house or 80 m²” on a small bungalow means the 50% wins. People design to the big number and get a correction notice back.

Check the zone, not just the town

Most towns have different numbers for urban, estate, rural and agricultural zones. Caledon, Brampton and Ottawa all split their rules by zone. Look up your zone on the town map first.

Do not trust a closed grant

Several 2025 programs in this table are already closed or fully subscribed. Never build a budget on a grant until you have an approval letter, and never start work before it.

Old by-law, new law

Some consolidated by-laws we read still show pre-Bill 23 wording. Where a by-law conflicts with the Planning Act or O. Reg. 299/19 on an urban serviced lot, the provincial rule wins. Ask the town how it is applying it.

Pre-consult before you pay for drawings

Most planning departments will look at a sketch and a survey before you commit. Twenty minutes on the phone is cheaper than paying a designer to draw the same building twice.

Skip the PDFs. Check Your Town in One Click.

The free Rules Checker shows every field we have for your municipality, the drawings you will need and the next step. No email, no account.

Questions & Answers

Rules by City Questions

Can I build a garden suite anywhere in Ontario?

On most urban lots with town water and sewer, yes. The Planning Act lets you have up to three units on a serviced urban residential lot, and one can be in a separate backyard building. On rural lots and lots on septic, the province does not guarantee it, so your township’s own by-law decides, and some still treat a backyard unit as a temporary garden suite.

Which Ontario city has the biggest garden suite size limit?

In our data, the largest published caps are on rural and farm lots: Centre Wellington allows a detached unit up to 186 m² on agricultural lots, Puslinch 130 m², Lakeshore 120 m² (140 m² agricultural). Toronto allows 120 m² for a two-storey suite. North Bay and Niagara Falls publish no size cap at all, only coverage and setbacks.

Which city has the smallest limit?

Brampton, at 35 m² (about 377 sq ft) in residential zones, is the tightest published cap in our table. Mississauga allows 55 m² one storey on lots of 550 m² or less. Ottawa caps a coach house footprint at 80 m² or 95 m² depending on the area, and lower on a small house or yard. Check the size limits page for every town side by side.

Did Ontario change the garden suite rules in 2024?

Yes. Amendments to O. Reg. 299/19 decided in December 2024 (ERO 019-9210) apply to urban residential land that allows three units. They guarantee at least 45% lot coverage, override floor space index limits, angular plane rules and ARU-specific minimum lot sizes, and cap the separation a town can require between residential buildings at 4 m. Towns still set size, height and setbacks.

Do I pay development charges on a garden suite?

Usually not for the second or third unit on a lot with a house. The Development Charges Act exempts additional units, including one in an ancillary building, on lots with a detached, semi or townhouse. Education charges and special cases vary, so confirm with your town before you budget. More on our development charges page.

What does garden suite mean in a township?

Often something different. In many rural townships a garden suite is a temporary, usually portable unit approved by a temporary use by-law under the Planning Act, for up to 20 years with extensions, tied to a removal agreement. Essa, Ramara, Severn, Tay, Tiny and Cavan Monaghan all use the term this way. See our temporary garden suite guide.

Are there grants for garden suites in 2026?

Some. In our data the open or listed programs include the County of Simcoe Secondary Suites Program (up to $50,000 forgivable), Bruce County (up to $50,000), Muskoka MAHIP ($40,000 or $50,000), Hamilton (up to $40,000), Kingston (up to $40,000) and Puslinch. Several 2025 programs are closed. Our funding directory keeps the status current.

How accurate is this table?

Every row was checked against the town’s own page or by-law in October 2026, and every town name links to that source. Where a number was not published or we could not confirm it, we say so instead of guessing. It is still a summary, not a zoning certificate: confirm with your town’s zoning review before you design.
